According to Tuesday’s New York Daily News, the woman whose dog was fatally shot by police officers in Saint Clair Shores, Mich., in late 2013, has filed a lawsuit.
Brittany Preston’s one-year-old Labrador retriever mix, “Lexie,” was shot multiple times by police officers on November 22, 2013. On the day of the shooting, Lexie had been in the care of Preston’s grandfather, who suffers from dementia; the man had forgotten that Lexie was left outside and the dog was barking, prompting a call to the police from disgruntled neighbors.
Preston’s attorney, Chris Olson, told the Huffington Post:
They had a premeditated intent to kill the dog and that is exactly what they did.
Olson spoke of the dialog which was captured on one of the police cruiser’s dash cams; he stated:
Before even getting out of the car, an officer is heard saying, ‘The only thing I’m gonna do is shoot it anyway. I do not like dogs,’
More comments about the killing of Lexie can be heard on the recording, including:
“I don’t do snares, I don’t do dogs … I’ll shoot the f–king thing.”
The forgotten dog who was suddenly being surrounded by police officers and animal control was allegedly perceived as a threat by the officers who responded to the call. The confused grandfather offered little help in the situation, forgetting at one point that the dog was meant to be at his home.
More recorded audio revealed a portion of the confusion and pending danger for the dog; the voice is allegedly from one of the officers at the scene:
Hey, here is what I’m gonna tell you, if this isn’t your dog, then you don’t care if I shoot it because I’m about to,”
“I’m very close to killing this dog, do you understand what I’m telling you right now? I will kill this dog. So if this is your damn dog, bring it in the house.”
A necropsy on the doomed dog revealed a total of 15 gunshot wounds; Lexie died inside of the animal control truck.
Preston’s lawsuit is directed at the city of St. Clair Shores, police Officers David Jacquemain and Jeremy Moskwa, and animal control officer Tom Massey. The authorities maintain that Lexie charged at the officers before they opened fire.
